RELATED POLICIES
These Terms should be read together with our Shipping Policy, Refund Policy and Privacy Policy, which form part of your agreement with us. Where those policies describe a process in more detail, that description applies.
1. GENERAL & ACCOUNT TERMS
1.1 By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country or state of residence.
1.2 To purchase products or services, you may be required to provide personal details (email, billing, payment, and shipping address). You warrant that all information provided is accurate, current, and complete.
1.3 You are solely responsible for maintaining the confidentiality of your account credentials. You may not transfer or assign your account to any third party.
1.4 We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion in the event of a breach of these Terms.
2. PRODUCTS, PRICING, AND TAXES
2.1 Product Descriptions: We make every effort to display the colors, specifications, and images of our products accurately. However, display settings on your device may affect visual representation.
2.2 Pricing & Currency: Prices are displayed in the currency shown at checkout for your market and include applicable Value Added Tax (VAT) unless stated otherwise. Prices do not include delivery charges, installation fees, or potential local import duties/customs fees where applicable outside the EU fiscal area.
2.3 Price Adjustments: We reserve the right to modify prices, discounts, and product availability at any time without prior notice. The price applicable to your purchase is the price published at the time your order is submitted.
2.4 Business Customers & VAT: Where you purchase as a business or public authority, prices are shown excluding VAT, and VAT is applied at checkout according to your delivery country and VAT status. Where you supply a valid EU VAT registration number for a country other than Denmark, the supply is generally zero-rated and VAT is accounted for by you under the reverse charge procedure.
3. ORDER FORMATION & ACCEPTANCE
3.1 Offer to Purchase: Submitting an order constitutes an offer to purchase our products or services.
3.2 Order Receipt vs. Acceptance: Upon placing an order, you will receive an automated email receipt confirming that we have received your order request. This email is an electronic acknowledgment only and does not constitute a legally binding acceptance of your order.
3.3 Contract Binding: A binding agreement is formed only when we dispatch your goods or issue a formal order confirmation/shipping invoice.
3.4 Cancellation by Us: We reserve the right to cancel any order prior to dispatch due to obvious pricing errors, technical glitches, inventory shortages, or delivery impediments. If your payment has already been processed, we will issue a full refund immediately.
4. PAYMENT & BILLING
4.1 Supported Payment Methods: Payment can be made using major credit/debit cards (Visa, Mastercard, etc.), bank transfers, or third-party payment providers available at checkout.
4.2 Pre-authorization & Charging: When paying by credit card, funds may be reserved/pre-authorized upon order placement. Your card will be debited when the item is dispatched or when production of a custom order begins.
4.3 Corporate & Credit Purchases (B2B): For authorized corporate clients, invoices are payable according to the agreed credit terms. Late payments accrue interest in accordance with applicable statutory commercial interest rules.
5. RETENTION OF TITLE (B2B PURCHASES)
For business-to-business (B2B) transactions where credit or invoice payment is extended, all delivered goods remain the sole legal property of Safegear until the purchase price, including shipping, taxes, and potential late interest, has been paid in full.
6. SHIPPING, DELIVERY, AND TRANSPORT DAMAGE
6.1 Delivery Estimates: Delivery times provided on the site are estimates. We are not liable for delays caused by logistics partners, customs clearance, or force majeure events.
6.2 Split Deliveries: Orders containing multiple items (e.g., a heavy safe and a fire extinguisher) may be dispatched separately from different distribution hubs and delivered on different dates.
6.3 Delivery Conditions: Freight delivery is made to the curb/ground floor level unless professional white-glove placement or installation services have been explicitly booked in advance.
6.4 Unsuccessful Delivery: If you are absent at the scheduled delivery time agreed with the carrier, you may be charged additional re-delivery freight fees.
6.5 Transport Damage Protocol:

Risk of loss transfers to you upon physical receipt of the goods.

You must inspect the external packaging upon delivery. If the packaging shows visible signs of damage, you must note the damage on the carrier's consignment note ("received with reservation") before signing, or refuse the shipment entirely.

Hidden damage discovered after unpacking must be reported to Safegear immediately alongside photos of the product and original packaging. Original packaging must be retained for carrier claims.
7. SPECIALIZED SERVICES: PLACEMENT & INSTALLATION OF SAFES
7.1 Third-Party Installation: Delivery into a building, floor placement, and anchoring/bolting of heavy safes are performed by specialized logistics partners.
7.2 Access & Floor Capacity Requirements:

The customer is solely responsible for ensuring that the pathway (door widths, staircases, elevator weight limits) and destination floor can bear the physical weight of the safe.

Safegear and its partners accept no liability for structural floor or property damage resulting from inadequate load capacity.
7.3 Additional Access Surcharges: Freight and installation quotes assume standard, obstacle-free access. If actual site conditions require additional preparations (e.g., protective floor plates, stair-climbing equipment), Safegear reserves the right to invoice the customer retroactively for these extra costs.
7.4 Customer Presence Mandate: The customer or an authorized representative must be present during placement and bolting. Before installation begins, the customer must verify that the delivered product matches the ordered model, color, size, and lock configuration.
7.5 Hidden Pipes & Wiring: The customer is strictly responsible for informing installers of hidden utility installations (e.g., underfloor heating, water pipes, electrical wiring) prior to drilling/anchoring. Safegear and its partners disclaim liability for damage to undisclosed hidden infrastructure.
7.6 Service Non-Refundability: Specialized installation and bolting fees are non-refundable once the service execution has commenced with your prior consent.
8. RIGHT OF WITHDRAWAL & RETURNS (CONSUMER B2C ONLY)
If you are purchasing as a consumer residing within the European Union or European Economic Area, you have a statutory right to cancel your purchase within 14 days without giving any reason.
8.1 Withdrawal Period: The 14-day withdrawal period expires 14 days from the day on which you (or a designated third party) take physical possession of the goods (or the last item of a multi-item order).
8.2 Notification: To exercise your right of withdrawal, you must notify us via an unambiguous written statement (e.g., email to info@safegear.com). You may use the standard withdrawal form in Section 22.
8.3 Return Shipping Costs: You must return the goods without undue delay and no later than 14 days after notifying us. You must bear the direct cost of returning the goods. Heavy safes require freight carrier, and the cost varies considerably with weight and distance.
8.4 Condition of Returned Items: You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods (similar to what is permitted in a physical retail store).
8.5 Refund Process: We will refund all payments received from you, including standard delivery costs (excluding supplementary costs if you chose a premium delivery option), within 14 days of receiving your cancellation notice. We may withhold the refund until we have received the goods back or received proof of return.
8.6 Business & Public-Sector Purchases: The statutory right of withdrawal applies to consumers only. Business and public-sector customers have no right of withdrawal unless this has been specifically agreed in writing before the purchase. Where withdrawal has been agreed, goods must be returned within 14 days of notifying us, you bear the direct cost and risk of return, delivery costs are not refunded, and any diminished value is deducted from the refund.
9. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to:

Goods manufactured to your personal specifications or clearly personalized (e.g., custom safe dimensions, bespoke lock combinations, special paint colors).

Service contracts (such as installation or maintenance) after the service has been fully performed, if performance began with your explicit prior consent acknowledging the loss of your right of withdrawal upon completion.
10. STATUTORY WARRANTY & DEFECT CLAIMS
10.1 Consumer (B2C) Legal Guarantee: In accordance with EU consumer protection directives, consumers are entitled to a mandatory statutory guarantee period of 24 months from the date of delivery. If a product is defective, you are entitled to repair, replacement, price reduction, or a refund depending on the situation.
10.2 Business (B2B) Warranty: For commercial purchases, a 12-month warranty applies from the delivery date unless agreed otherwise in writing. Defects must be reported immediately upon discovery.
10.3 Exclusions: The warranty does not cover normal wear and tear, improper maintenance, failure to follow operating instructions, unauthorized repairs, external force, or consumable items (such as standard batteries included with electronic locks).
11. USER MANUALS & INSTRUCTIONS
Product manuals may be supplied in English or digital format (PDF, video tutorials, online documentation downloadable from our website). If you require assistance operating a product due to language preferences, please contact our support team.
12. LIMITATION OF LIABILITY
12.1 To the extent permitted by applicable law, Safegear shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of profits, business interruption, or loss of data arising from the use of or inability to use our products or services.
12.2 Nothing in these Terms limits our liability for death, personal injury caused by negligence, fraud, or liabilities that cannot be excluded under applicable consumer laws.
13. INTELLECTUAL PROPERTY
All content on this website—including text, graphics, logos, images, digital downloads, software, and media—is the exclusive property of Safegear or its content suppliers and is protected by international copyright, trademark, and intellectual property laws. You may not extract, reproduce, or redistribute site content without our prior written consent.
14. RELATIONSHIP WITH SHOPIFY
Safegear is hosted on the Shopify e-commerce platform. Shopify provides us with the online infrastructure that enables us to offer our products to you. You acknowledge and agree that your purchase contract is executed directly with Safegear ApS and not with Shopify Inc.
15. PROHIBITED USES & AUTOMATED AGENTS
You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to violate international regulations or local laws; (c) to infringe upon intellectual property rights; (d) to transmit malicious code or viruses; (e) to collect personal information of others; or (f) to employ unauthorized automated scraping tools, AI crawlers, or agents that mimic human interaction without identifying themselves via standard header protocols.
16. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Safegear, its parent, affiliates, partners, officers, directors, employees, and suppliers from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or third-party rights.
17. SEVERABILITY & ENTIRE AGREEMENT
If any provision of these Terms is deemed unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed without affecting the validity and enforceability of all remaining provisions. These Terms constitute the entire agreement between you and Safegear regarding your use of the website and purchase of products.
Governing Language: These Terms are drafted in English. Translations are provided for convenience. In the event of any discrepancy between the English version and a translation, the English version prevails, except where mandatory law in your country of residence requires otherwise.
18. GOVERNING LAW AND JURISDICTION
18.1 Applicable Law: These Terms and any separate sales agreements shall be governed by and construed in accordance with the laws of Denmark, without regard to conflict-of-law principles.
18.2 Consumer Protection Safeguard: If you are an EU consumer, you also benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your rights as a consumer to rely on such local mandatory provisions.
19. COMPLAINTS & DISPUTE RESOLUTION
19.1 If you have a complaint regarding a purchase or service, please contact us first at info@safegear.com so we can attempt to resolve the issue directly and amicably.
19.2 European Consumer Out-of-Court Settlement: If a dispute cannot be settled directly with Safegear, consumers residing in the EU/EEA may seek out-of-court assistance through their competent national Alternative Dispute Resolution (ADR) body or via the European Consumer Centres Network (ECC-Net).
19.3 Official ADR Directory: A complete list of certified national dispute resolution entities across EU/EEA Member States is available via the European Commission at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.
